JOB MATCHY Terms and Conditions of Use
These Terms and Conditions ("Terms") govern the use of the job matching application "JOB MATCHY" provided by JOBMATCHY NEPAL Pvt. Ltd. ("Company"). By registering and using the services ("Service"), users ("User") agree to abide by these Terms.
Users must read and agree to these Terms before using the Service.
Users must be registered members to access the Service.
By registering, an agreement ("Agreement") is established between the User and the Company.
Users who do not agree to these Terms must refrain from using the Service.
These Terms apply to all Users of the Service.
If any provision conflicts with Nepalese law, only the conflicting provision will be deemed invalid, and the remaining provisions will remain effective.
These Terms apply to all actions related to the use of the Service, including browsing, registration, and communication between Users.
The Service facilitates job matching between Nepalese businesses and non-Nepalese job seekers.
Some features are free, while paid services may offer enhanced communication options.
The Company does not guarantee successful job placement.
The Company reserves the right to modify or discontinue any part of the Service at its discretion.
User: Any individual or business registered to use the Service.
Content: Any data or information provided by Users through the Service.
Profile Information: User details such as name, nationality, work history, and other relevant personal information.
Paid Service: Optional paid membership benefits, including advanced features such as direct messaging.
The Company may modify, suspend, or terminate the Service at its discretion without prior notice.
The Company does not guarantee uninterrupted or error-free service.
The Company is not liable for damages except in cases of willful misconduct or gross negligence.
The Company does not guarantee that the Service will be compatible with all devices or operating systems.
The Service is for non-Nepalese job seekers and Nepalese employers.
Users must be at least 18 years old.
The Company reserves the right to refuse registration or terminate accounts for violating these Terms or providing false information.
The Company reserves the right to deny registration or cancel accounts if the User is linked to criminal activities, antisocial forces, or any form of illegal conduct.
Users are responsible for the accuracy of their profile and posted content.
Users must ensure the security of their account credentials and may not share their login information with third parties.
Users must not misuse or distribute personal or job-related information obtained through the Service.
Users must comply with all relevant laws and regulations regarding employment, anti-discrimination, and fair labor practices.
Users are solely responsible for disputes arising from their use of the Service and must resolve such disputes independently.
Users must not:
Provide false or misleading profile information.
Share personal contact details before an official match.
Use the Service for unauthorized purposes such as solicitation, fraud, or illegal activities.
Harass, defame, or threaten other Users.
Violate intellectual property rights or infringe on copyrighted materials.
Engage in actions that disrupt the normal operation of the Service.
The Company may suspend or delete accounts without prior notice if:
The User violates these Terms.
The User fails to pay for Paid Services.
The User is linked to fraudulent or illegal activities.
The User remains inactive for six months.
The User is suspected of having ties to antisocial forces.
The Company reserves the right to review and delete inappropriate messages exchanged through the Service.
Basic services are free, while certain features require a paid subscription.
Paid Users must pay via accepted methods (credit card, bank transfer, etc.).
Subscription plans automatically renew unless canceled by the User.
Refunds for Paid Services are not available unless required by Nepalese law.
The Company may use User data for service improvement and operational purposes.
Users retain copyright over their posted content but grant the Company a non-exclusive, royalty-free license to use it within the Service.
The Company owns all intellectual property related to the Service, including trademarks, software, and branding.
Users may not collect or distribute data from the Service through automated means (e.g., crawling, scraping).
Users must contact the Company through official communication channels such as the support email or in-app contact form.
The Company may send important notifications via email or SMS.
The Company is not responsible for delivery failures due to incorrect User contact details.
Users are responsible for resolving disputes arising from their use of the Service.
The Company is not liable for disputes between Users but may intervene at its discretion.
In cases of unresolved disputes, Users must seek resolution through Nepalese legal processes.
The Company follows strict privacy policies to protect User data.
User information may be used to enhance the Service but will not be shared with third parties without explicit consent, except where required by law.
Employers must provide accurate job details and ensure that listings comply with Nepalese labor laws.
Misleading, fraudulent, or false job postings are prohibited.
Employers must clearly outline employment terms, including wages, hours, and working conditions.
The Company may revise these Terms at its discretion.
Changes will be communicated, and continued use of the Service constitutes acceptance.
If a change significantly affects User rights, Users will be notified in advance.
These Terms are governed by the laws of Nepal.
Disputes arising from these Terms will be subject to the exclusive jurisdiction of Nepalese courts.
